Terms Of Use

1.1 It is our mission to help those tackling and studying the negative impacts of global industrial food animal production (especially in low- and middle-income countries) gain the clearer, firmer, deeper understanding that is needed to figure out and implement solutions to this complex problem. However, to preserve the integrity of the content we provide and to protect how it is distributed, your use of materials contained on our Site is subject to these Terms of Use.

1.2 Acceptance of the Terms of Use:

If you visit this Site or choose to use any features of this Site as an individual or on behalf of your organization, you and your organization, as appropriate (hereafter as “User”, “you” or “your”) signify that you have read, understand and agree to accept and be bound by these Terms of Use. Please read the Terms of Use carefully before you start to use our Site. If you do not agree to these Terms of Use or the Privacy Policy or copyright policy, you should not access or use our Site.

1.3 Changes to the Terms of Use:

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time without notice, which shall become effective immediately upon posting. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use.

We reserve the right to discontinue or modify our Site, including the availability of any material, database, or content, in our sole discretion at any time with or without notice. These materials do not necessarily reflect our opinion, and we do not necessarily endorse all the information and views expressed in these materials. 

4.3 We may update the content on our Site from time to time, but its content is not necessarily complete or up-to-date. Any of the material on our Site may be out of date at any given time, and we are under no obligation to update such material.

5.1 Access to certain portions of the Site requires registration, the process for which is initiated by sending an email to min@tinybeamfund.org. If you are required to provide information about you in the course of registering to use the Site, you agree to provide accurate and complete information about you, e.g., as may be prompted by any registration forms on the Site. To the extent such information about you changes, you agree to promptly update such registration information with the Site to keep it accurate, current and complete. While you are allowed to share Site access credentials with peers, you shall not register for more than one User account or impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity.

5.2 You agree not to publish or disseminate Site access credentials beyond your discreetly sharing them with peers.

5.3 You agree that we may, with or without cause, immediately terminate your registration and access to the Site without prior notice.

5.4 Membership registration presently is free, but we reserve the right to begin charging for access at any time.

6.1 You may use our Site only for lawful purposes and in accordance with these Terms of Use. You agree not to use our Site in any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from

the U.S. or other countries).

6.2 Additionally, you agree not to:

6.2.1 Use our Site in any manner that could disable, overburden, damage, or impair our Site or interfere with any other party’s use of our Site.

6.2.2 Use any robot, spider, or other automatic device, process, or means to access our Site for any purpose, including monitoring or copying any of the material on our Site.

6.2.3 Use any device, software, or routine that interferes with the proper working of our Site.

6.2.4 Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

6.2.5 Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our Site, the server on which our Site is stored, or any server, computer, or database connected to our Site.

6.2.6 Otherwise attempt to interfere with the proper working of our Site.

7.2 We are not responsible for the availability of these outside resources, their contents, any link contained in a linked site, or any changes or update to such site. 9.4 THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

UNDER NO CIRCUMSTANCES SHALL TINY BEAM FUND, INC., ITS PARTNERS, CONTRIBUTORS, AGENTS, EMPLOYEES, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING BUT NOT LIMITED TO SUCH DAMAGES FOR LOST DATA, DUE TO YOUR USE OF THIS SITE OR DUE TO YOUR RELIANCE ON ANY OF THE CONTENT CONTAINED OR THE SERVICES PROVIDED ON OR THROUGH THE SITE.

11.1 You agree to indemnify and hold harmless Tiny Beam Fund, Inc. and its respective members, directors, officers, employees, contractors, agents, licensors, suppliers, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms of Use or your use of our Site. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Tiny Beam Fund, Inc., in its sole discretion, may discontinue, terminate, or restrict your access to all or part of the Site for any reason, including, without limitation, breach or assignment of these Terms of Use, without notice and without any liability to you.

13.1 All matters relating to our Site and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the United States and the Commonwealth of Massachusetts without regard to conflict of law principles.

13.2 Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or our Site shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Massachusetts, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13.3 Any cause of action or claim you may have arising out of or relating to these Terms of Use or our Site must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

14.1 If a court or other tribunal of competent jurisdiction finds any provision in these Terms of Use to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

15.1 Notwithstanding any of the foregoing, nothing in these Terms of Use will serve to preempt the promises made in policies or terms and conditions in addition to these Terms.

15.2 The failure of the Institute to enforce any provisions of the Terms or to respond to a breach by you or other parties shall not in any way waive its rights to enforce subsequently any terms or conditions of the Terms or to act with respect with similar breaches.

15.3 These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and us regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
